Licensing FAQ

1. Do I need a licence for personal projects?

Every eligible Pink Octopus Art digital design purchase includes a Personal Use Licence at no additional cost.

You may use the design for your own personal craft projects, create items for yourself, and make gifts for friends and family.

A commercial licence is required if you wish to sell physical products featuring the design.

2. I want to sell physical products using a Pink Octopus Art design. Which licence do I need?

There are two commercial licence options:

Small Business Commercial Licence – £12 per design
Allows you to create and sell up to 100 physical products using one Pink Octopus Art design.

Extended Commercial Licence – £85 per design
Allows unlimited physical product sales using one Pink Octopus Art design and includes use with approved third-party print-on-demand services.

Each commercial licence applies to one design only and is non-transferable.

3. Can I sell products on Etsy or my own website?

Yes.

The Small Business Commercial Licence allows you to sell up to 100 physical products per licensed design through platforms such as Etsy, your own website, craft fairs and other retail channels.

If you wish to sell more than 100 physical products using the same design, you will need an Extended Commercial Licence.

4. Can I use Pink Octopus Art designs with print-on-demand services?

Print-on-demand use requires an Extended Commercial Licence.

This includes third-party production or fulfilment services such as Printify and similar POD providers.

The digital artwork itself must never be made available for customers or third parties to download, extract or redistribute.

5. Can I sell 3D printed products made using Pink Octopus Art digital files?

Yes, provided the particular file is sold with commercial-use licensing and you have purchased the appropriate licence.

Small Business Commercial Licence: up to 100 physical items per licensed design.

Extended Commercial Licence: unlimited physical items per licensed design.

The original digital file may not be resold, shared or redistributed.

6. Can I resell or share the digital design file?

No. Redistribution of the original digital files is not permitted under any licence.

You may not resell or share the original file, upload it to file-sharing websites, include it in digital bundles, or modify the artwork and resell it as another digital design.

Commercial licences permit the creation and sale of physical end products within the terms of the licence; they do not transfer ownership of the original artwork.

7. Who owns the copyright?

Pink Octopus Art retains copyright and ownership of the original artwork and digital files.

Purchasing a design or commercial licence gives you permission to use the design according to the terms of that licence. It does not transfer copyright or ownership of the artwork.

8. Are the licences exclusive?

No. All Pink Octopus Art licences are non-exclusive.

Pink Octopus Art may continue to sell, licence and use the same designs elsewhere.

9. Do I need to credit Pink Octopus Art?

Credit is appreciated but is not required when selling an authorised physical end product.

If you would like to provide credit, you can use:

10. Can I use a design as part of a logo or trademark?

No. Pink Octopus Art designs may not be registered as, or incorporated into, a trademark, business logo or other exclusive brand identity without prior written permission.

11. What happens if a design is used commercially without the appropriate licence?

Commercial use outside the terms of the applicable licence is not permitted and may constitute an infringement of Pink Octopus Art's intellectual property rights.
