Welcome to Pink Octopus Art. These Terms of Service apply when you visit or make a purchase from the Pink Octopus Art website.

Pink Octopus Art is an independent UK business. Our online store is powered by Shopify.

By using this website or placing an order, you agree to these Terms together with the policies displayed on our website, including our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms affects your statutory rights under applicable consumer law.

1. Products and Services

Pink Octopus Art offers a range of products which may include:

• Handmade and 3D printed physical products
• Personalised and custom-made products
• Digital artwork, patterns, files and downloads
• Commercial licences for eligible Pink Octopus Art designs
• Selected products fulfilled by third-party production partners

Product descriptions, photographs, prices and availability are provided as accurately as reasonably possible.

Colours and appearance may vary slightly depending on screen settings, materials and, where applicable, the handmade nature of a product.

2. Orders

When you place an order, you are offering to purchase the selected product or service.

Orders are subject to acceptance, product availability and successful payment processing. Pink Octopus Art reserves the right to refuse or cancel an order where reasonably necessary, including where there is an error in pricing or product information, an item is unavailable, or an order is identified as potentially fraudulent.

If an order is cancelled after payment has been taken, any applicable refund will be made to the original payment method.

Please ensure that the information supplied when ordering is complete and accurate.

3. Prices and Payment

Prices are displayed in the currency shown on the website and may change from time to time.

The price charged will be the price displayed when your order is placed, subject to correction of obvious errors.

Any applicable delivery charges will be displayed at checkout before you complete payment.

Payment is processed securely through the payment methods made available at checkout.

4. Physical Products and Delivery

Delivery options, charges and estimated delivery times for physical products are described in our Shipping & Delivery Policy and displayed where applicable during checkout.

Delivery dates are estimates and may occasionally be affected by circumstances outside our reasonable control.

Your statutory rights relating to delivery, faulty goods and goods that are not as described are not affected.

5. Returns, Cancellations and Refunds

Returns, cancellations and refunds are handled in accordance with our Refund Policy and applicable UK consumer law.

Different rules may apply to digital content and products made to a customer's individual specifications or personalised for them.

This does not affect your statutory rights where a product is faulty, damaged or not as described.

6. Personalised and Custom Products

Products personalised or made specifically to your individual requirements may not be eligible for cancellation or return simply because you have changed your mind, where permitted by applicable law.

Please check all names, wording, colours, sizes and other personalisation information carefully before placing an order.

Pink Octopus Art is not responsible for errors in personalisation information supplied by the customer.

7. Digital Products

Digital products are supplied electronically and no physical product will be posted unless expressly stated otherwise.

Where digital content is supplied immediately, cancellation rights may be affected once downloading or access has begun where the customer has expressly agreed to immediate supply and acknowledged the loss of the applicable cancellation right.

If you experience difficulty accessing a digital purchase, please contact Pink Octopus Art for assistance.

Purchasing a digital design does not transfer copyright or ownership of the artwork.

8. Copyright and Intellectual Property

Unless otherwise stated, Pink Octopus Art retains copyright and intellectual property rights in its original artwork, designs, graphics, digital files, photographs and other original creative content.

Purchasing a product does not transfer copyright or ownership of the underlying artwork.

Digital files may not be resold, shared, redistributed, uploaded to file-sharing services or claimed as your own except where expressly permitted by a written licence from Pink Octopus Art.

9. Personal Use Licence

Eligible Pink Octopus Art digital design purchases include a Personal Use Licence at no additional cost.

This permits use of the licensed design for personal, non-commercial projects and gifts.

A Personal Use Licence does not permit the sale of products featuring the design.

10. Small Business Commercial Licence

A Small Business Commercial Licence permits the licence holder to use one eligible Pink Octopus Art design to create and sell up to 100 physical products.

This may include handmade products, small-batch products and eligible physical 3D printed products.

The Small Business Commercial Licence does not permit print-on-demand use or redistribution of the original digital file.

Each licence applies to one design only and is non-transferable.

11. Extended Commercial Licence

An Extended Commercial Licence permits the licence holder to use one eligible Pink Octopus Art design for unlimited physical product sales and permitted print-on-demand production.

This may include larger production runs, eligible physical 3D printed products and use of eligible designs with third-party print-on-demand or fulfilment services.

The original digital file may not be resold, shared or redistributed.

Each licence applies to one design only and is non-transferable.

12. Commercial Licence Restrictions

No Pink Octopus Art licence permits you to:

• Resell, share or redistribute the original digital file
• Upload the original file for others to download
• Include the original artwork or file in a digital bundle for resale
• Modify the artwork and resell it as a new digital design
• Claim the original artwork as your own
• Register or incorporate the design into a trademark, business logo or exclusive brand identity without prior written permission

Commercial licences are non-exclusive. Pink Octopus Art retains copyright and may continue to use, sell and license the design elsewhere.

13. Third-Party Services and Marketplaces

Our website may contain links to third-party services or marketplaces.

Where you purchase directly through an external marketplace, such as Redbubble or Spoonflower, the transaction is made through that marketplace and its applicable ordering, delivery and returns processes apply.

Pink Octopus Art is not responsible for the operation or content of independent third-party websites.

14. Shopify

The Pink Octopus Art online store is powered by Shopify, which provides the ecommerce platform used to offer products and services to customers.

Purchases made directly from the Pink Octopus Art store are transactions with Pink Octopus Art, not Shopify.

Personal information processed through the store is handled in accordance with our Privacy Policy and the applicable Shopify privacy terms.

15. Acceptable Use

You must not misuse this website, attempt to interfere with its security or operation, introduce malicious software, use the website for unlawful purposes, or infringe the intellectual property rights of Pink Octopus Art or another party.

16. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including any rights or remedies that cannot legally be excluded under applicable consumer law.

To the extent permitted by law, Pink Octopus Art will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

17. Privacy

Personal information is collected and processed in accordance with the Pink Octopus Art Privacy Policy.

Our store is hosted by Shopify, which also processes certain information in connection with providing its ecommerce services.

18. Changes to These Terms

These Terms may be updated from time to time to reflect changes to our products, services, business practices or applicable requirements.

The latest version will be published on this website with an updated revision date where appropriate.

Changes will not retrospectively remove statutory rights relating to orders already placed.

19. Governing Law

These Terms are governed by the laws applicable in England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also have rights under the mandatory laws applicable where you live.

Nothing in these Terms prevents a consumer from exercising any rights regarding jurisdiction that cannot legally be excluded.
